MarketManic operates a network of community-specific online marketplaces. This Platform serves the Palompon community and forms part of the broader MarketManic marketplace network.
By accessing or using this Platform, you agree to be bound by these General Terms & Conditions (“General Terms”). If you do not agree, please do not use the Platform.
Users who register as Vendors (sellers) are required to agree to a separate Vendor Terms & Conditions, which govern seller fees, listings, payouts, taxes, commissions, memberships, and other Vendor-specific obligations.
1. About MarketManic and the Community Marketplace Model
MarketManic operates a network of separate, community-specific online marketplaces. Each community marketplace, including palompon.marketmanic.com, is designed to serve a specific locality and operate independently in order to promote a safer, more relevant, and community-focused environment.
The website marketmanic.com is the official main website of MarketManic. It provides general information about the company and its marketplace network, but it does not handle user registration, checkout, transactions, or marketplace operations. All user accounts, listings, transactions, and related data are managed exclusively within each individual community marketplace website.
2. Users, Eligibility, and Legal Capacity
Individuals who register on the Platform may act as buyers or sellers. Buyers and sellers are collectively referred to in these General Terms as “Users.”
You must be at least 18 years old to use this Platform. By using the Platform, you confirm that you are legally capable of entering into binding agreements and that all information you provide is accurate, complete, and kept up to date.
3. Account Registration and Responsibility
Certain features of the Platform require you to create an account. When registering, you agree to provide accurate and complete information and to keep your login credentials confidential.
You are responsible for all activities carried out under your account, whether performed by you or by someone using your login details. If you believe your account has been compromised, you must notify us immediately.
MarketManic may suspend or terminate accounts that violate these General Terms or that pose a risk to other Users or to the community.
4. Marketplace Role and Disclaimer
The Platform provides the technical infrastructure that allows Users to list goods or services, browse listings, and complete transactions within the Palompon community.
MarketManic is not a buyer or seller of goods or services listed on the Platform. We do not take ownership or possession of listed items, and we do not guarantee the quality, safety, legality, accuracy, or delivery of any product or service offered by Users.
Any transaction completed through the Platform forms a direct agreement between the buyer and the seller. MarketManic is not a party to that agreement and is not responsible for the performance, conduct, or obligations of either party.
5. Listings and User Content
Users may post listings, descriptions, images, messages, and other materials (“User Content”) on the Platform.
By posting User Content, you confirm that you have the legal right to share it, that it is accurate and not misleading, and that it does not violate any law or the rights of any third party.
Content that is illegal, stolen, counterfeit, fraudulent, misleading, abusive, harmful, or otherwise inappropriate for a community marketplace is strictly prohibited. MarketManic reserves the right to remove or restrict access to any User Content that violates these General Terms or community standards.
6. Community Standards and Local Focus
This Platform is intended specifically for the Palompon community. Users are expected to act respectfully and to use the Platform only for lawful and community-appropriate purposes.
Conduct that undermines trust, safety, fairness, or the well-being of the community may result in warnings, content removal, temporary suspension, or permanent termination of an account.
7. Checkout, Payments, and Third-Party Services
The Platform includes an integrated online checkout system to facilitate transactions between Users.
Payments are processed through third-party payment service providers. MarketManic does not directly process payments and does not store full credit or debit card details.
The Platform may support one or more payment methods, including credit or debit cards and other online payment channels made available by the third-party payment provider. The availability of specific payment methods may vary and may change without prior notice.
By completing a purchase, the buyer agrees to pay all prices, applicable taxes, delivery charges, and fees displayed at checkout and authorizes the selected payment method to be charged for the full transaction amount.
MarketManic is not responsible for any loss or damage arising from incorrect shipping or payment information provided by a User, unauthorized use of a payment method, failed or delayed transactions caused by the payment provider, or payment errors made by the buyer.
We reserve the right to review, suspend, or cancel a transaction if we reasonably believe that a payment method is unauthorized, fraudulent, or otherwise invalid.
Refunds, cancellations, and disputes relating to purchased items are generally matters to be resolved directly between the buyer and the seller, unless otherwise required by applicable law. Vendor fees, commissions, memberships, payouts, and other seller-specific financial obligations are governed exclusively by the Vendor Terms & Conditions.
8. Intellectual Property
All Platform content, trademarks, logos, software, and design elements, excluding User Content, are owned by or licensed to MarketManic and are protected by applicable intellectual property laws.
You may not copy, modify, distribute, reproduce, or otherwise exploit Platform content without prior written permission.
By posting User Content, you grant MarketManic a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute such content for the purpose of operating and promoting the Platform.
9. Privacy
Your use of the Platform is governed by our Privacy Policy, which explains how personal data is collected, used, and protected within the respective community marketplace website.
10. Termination
MarketManic may suspend or terminate access to the Platform if these General Terms are violated, if a User’s conduct poses a risk to others or to the community, or if required by law or regulatory authorities.
You may stop using the Platform at any time.
11. Limitation of Liability
To the fullest extent permitted by law, MarketManic and its affiliates shall not be liable for disputes, losses, or damages arising from transactions between Users, errors or omissions in listings or User Content, loss of data or profits, or the actions or omissions of other Users or third parties.
Your use of the Platform is at your own risk.
12. Indemnification
You agree to indemnify and hold harmless MarketManic from any claims, damages, losses, liabilities, or expenses arising out of your use of the Platform, your violation of these General Terms, your transactions with other Users, or your breach of any law or third-party rights.
13. Changes to These General Terms
MarketManic may update these General Terms from time to time. Updated versions will be posted on this page with a revised “Last Updated” date.
Your continued use of the Platform after changes take effect constitutes acceptance of the updated General Terms.
14. Governing Law
These General Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law principles.
